By accessing or using Moy Stream ("Service"), a product of Moy Dev LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Moy Stream is a multi-camera live streaming platform that enables users to:

• Stream to multiple platforms simultaneously (YouTube, Twitch, Facebook, LinkedIn)
• Use multiple cameras including phones and webcams
• Utilize AI-powered features for automatic camera switching
• Add overlays, graphics, and professional production elements
• Record and download streaming sessions
• Invite remote guests to participate in streams

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent.

4. Subscription and Payments

4.1 Subscription Plans

We offer various subscription plans with different features and limitations. Plan details and pricing are available on our website.

4.2 Free Trial

New users may be eligible for a free trial period. After the trial ends, you will be charged unless you cancel before the trial period expires.

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis
• Payments are processed through Stripe
• You authorize us to charge your payment method automatically
• Prices are subject to change with 30 days notice

4.4 Cancellation and Refunds

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused features
• Annual subscriptions may be eligible for pro-rated refunds within 14 days

5. User Content

You retain ownership of all content you create, upload, or stream through the Service ("User Content"). By using the Service, you grant us a limited license to process and transmit your content as necessary to provide the Service.

5.2 Content Restrictions

You agree not to create, upload, or stream content that:

• Violates any law or regulation
• Infringes intellectual property rights of others
• Contains harmful, abusive, or hateful material
• Includes sexually explicit or violent content
• Promotes illegal activities or harm to others
• Contains malware or malicious code
• Violates the terms of connected streaming platforms

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

6. Third-Party Platforms

The Service integrates with third-party streaming platforms. When using these integrations:

• You must comply with each platform's terms of service
• We are not responsible for third-party platform policies or actions
• Your use of connected platforms is subject to their separate terms
• We may revoke platform connections if required by the platform

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service
• Reverse engineer or decompile any part of the Service

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Moy Dev LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of any content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOY DEV LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits, revenue, or data
• Business interruption
• Costs of substitute services
• Any damages arising from your use of the Service

Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Moy Dev LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including:

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Delaware.

15. Dispute Resolution

Before filing any legal claim, you agree to first contact us and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, any legal action must be filed within one (1) year of the event giving rise to the claim.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
